DNNUpdate is owned and operated by Inventua. Inventua reserves the right to change the DNNUpdate terms of service, terminate service and/or terminate the right to participate of any developer or user as Inventua sees fit. GRANT OF LICENSE. You may download, install and use or otherwise interact with ("RUN") the DNNUpdate service module (the SOFTWARE PRODUCT) on your server at no cost. Subscription charges may apply for products published by DNNUpdate suppliers on a subscription-only basis.
LICENSE EXPIRY. Your obligations as specified in this agreement do not expire unless otherwise specified.
ALL RIGHTS RESERVED. Inventua reserves all rights not expressly granted by this agreement.
COPYRIGHT. All title and copyrights in and to the SOFTWARE PRODUCT (including but not limited to any images, audio, text, and custom controls incorporated into the SOFTWARE PRODUCT), the accompanying printed materials, and any copies of the SOFTWARE PRODUCT are owned by Inventua or its suppliers. All title and intellectual property rights in and to the content that may be accessed through use of the SOFTWARE PRODUCT is the property of the respective content owner and may be protected by applicable copyright or other intellectual property laws and treaties. This agreement grants you no rights to use such content. Except as provided above, nothing herein shall be construed as conferring any right or license whatsoever under any copyrights, patents, trademarks or other intellectual property rights of Inventua, its licensors or any other party.
COPYRIGHT OF THIRD PARTY SOFTWARE. The SOFTWARE PRODUCT accesses the DNNUpdate service to provide upgrades to application files provided by third party software publishers. Documents or data files "served" (downloaded) using DNNUpdate may contain proprietary notices and copyright information applicable to that document or file. Your right to use or copy any document may be restricted if so indicated in such proprietary notices and/or copyright information.
WARRANTY. Inventua does not warrant that the SOFTWARE PRODUCT can be used without interruption, or shall provide any function not designated in the specifications, is or will be error free or virus free and the Customer acknowledges that the existence of any such errors does not constitute a breach of this agreement. Whilst Inventua has endeavoured to ensure that the Software works, Inventua does not guarantee that the Software will work on all computer hardware platforms or configurations.
NO OTHER WARRANTIES. To the maximum extent permitted by applicable law, Inventua and its suppliers disclaim all other warranties and conditions, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, with regard to the SOFTWARE PRODUCT, and the provision of or failure to provide support services. This limited warranty gives you specific legal rights. You may have others, which vary from state/jurisdiction to state/jurisdiction.
LIMITATION OF LIABILITY. To the maximum extent permitted by applicable law, in no event shall Inventua or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information, or any other pecuniary loss) arising out of the use of or inability to use the SOFTWARE PRODUCT or the provision of or failure to provide Support Services, even if Inventua has been advised of the possibility of such damages. In any case, Inventua’s entire liability under any provision of this EULA shall be limited to the amount actually paid by you for the SOFTWARE PRODUCT; provided, however, if you have entered into an Inventua Support Services Agreement, Inventua’s entire liability regarding Support Services shall be governed by the terms of that agreement. Because some states and jurisdictions do not allow the exclusion or limitation of liability, the above limitation may not apply to you.
